Terms of Use

Art. 1 — Site owner and contacts

The website www.jrose.it is operated by AFFRESCHI & AFFRESCHI S.R.L., a single-member company with registered office at Via Giurdignano SNC, Zona PIP, Lotto 9/A, 73027 Minervino di Lecce (LE), registered with the Lecce Register of Companies under registration number and tax code 04779110750, REA LE-317690, VAT number 04779110750, fully paid-up share capital of euro 10,000.00, PEC affreschisrls@pec.it, email info@jrose.it, telephone 0836 891054 (hereinafter also “J.Rose” or the “Operator”).

For support relating to the site, and to report technical problems, vulnerabilities, abuse or violations, you can write to info@jrose.it. For formal communications, the PEC affreschisrls@pec.it may be used.

Art. 2 — Subject matter and acceptance

These Terms of Use govern access, browsing, account creation and use of the general features of www.jrose.it.

By accessing or using the site, the user agrees to comply with these terms and with applicable law. If the user does not agree, they must stop using the features concerned.

Purchases made in the online shop are governed by the Terms of Sale and by the Payments, Shipping and Returns & Refunds pages. Membership, Collectors Club, Limited Editions, Message in a Bottle, Wallet, digital passports and other special projects are also governed by their respective rules and notices.

Art. 3 — Recipients, legal age and alcohol content

The site also presents and sells alcoholic beverages. The areas and features relating to alcohol are intended for users who have reached the minimum age required in their country and, in any case, not less than 18.

Users must make truthful declarations in age-gate or age-verification systems and must not facilitate access to or purchase of alcohol by minors.

The communications on the site do not encourage excessive consumption and do not attribute therapeutic, social or performance effects to alcohol. J.Rose promotes responsible drinking.

Art. 4 — Account and credentials

Where a personal area is available, the user must provide correct, up-to-date data that refers to themselves or to the organisation they are authorised to represent.

Credentials are personal and must be kept carefully. The user must promptly inform J.Rose of suspicious access, theft of credentials or unauthorised use.

J.Rose may require a password reset, temporarily restrict an account or suspend it where there are reasonable grounds of security, fraud, breach of law or non-compliance with these terms. Where possible, the user is informed of the reason.

The special rules on OTP, PIN, Wallet, Collectors Club or digital passports prevail for their respective areas.

Art. 5 — Permitted uses and prohibited conduct

The site may be used for lawful personal or professional purposes, in compliance with the rights of J.Rose and of third parties.

It is prohibited, in particular, to:

  • attempt to access systems, accounts, data or restricted areas without authorisation;
  • circumvent age checks, territorial restrictions, anti-fraud measures or security systems;
  • use bots, scripts, mass scraping or automated procedures that compromise the site or extract content beyond what the law permits;
  • transmit malware, malicious code, deceptive communications or content that is unlawful, offensive or harmful to the rights of others;
  • use the site for fraud, card testing, fictitious orders, money laundering or other unlawful activities, including mass, automated or fraudulent purchases intended for resale;
  • reproduce or commercially exploit content, images, works, trademarks or databases without authorisation.

J.Rose may adopt proportionate technical measures, limit anomalous requests, cancel fraudulent transactions and cooperate with authorities and payment providers in the cases provided by law.

Art. 6 — Intellectual property

Trademarks, names, works, images, photographs, videos, illustrations, labels, texts, graphics, layouts, software and content on the site belong to their respective owners or are used under licence.

Browsing and purchasing do not transfer rights of reproduction, modification, publication, commercial exploitation or distribution. Only personal uses and those expressly permitted by law are allowed.

J.Rose's artistic materials, including packaging, labels, works and collaborations with artists, may not be used to create unauthorised products, campaigns or commercial content.

Art. 7 — Content and communications sent by the user

The user warrants that any data, requests, reviews, photographs or other materials sent through the general features of the site are lawful, relevant and do not infringe third-party rights.

Sending a support request or material does not grant J.Rose rights beyond those necessary to handle the communication, except under a specific agreement or consent.

Content uploaded in special services is governed exclusively by their respective terms and not by this article.

Art. 8 — Site availability and security

J.Rose adopts reasonable measures to keep the site available, up to date and secure, but does not guarantee uninterrupted or error-free operation.

The site may be temporarily suspended for maintenance, updates, security, supplier failures, force majeure or urgent interventions. Where possible, scheduled activities are organised to reduce inconvenience.

The user must use up-to-date and adequately protected devices. J.Rose is not liable for damage caused by compromised devices, shared credentials or the user's conduct, except for mandatory liabilities.

Art. 9 — Third-party links and services

The site may contain links or components provided by third parties, including payment providers, maps, social networks, Wallet systems, logistics platforms or artists' websites.

When the user accesses an external service, the terms and notices of that provider also apply. J.Rose does not control the content or availability of third-party sites, without prejudice to what is directly attributable to the Operator.

Art. 10 — Privacy and cookies

The processing of personal data is described in the Privacy Notice published in the site footer and in the notices dedicated to individual features.

The use of cookies and similar technologies is governed by the Cookie Policy and by the preferences expressed in the consent management panel. Non-essential cookies must not be activated before consent where consent is required.

Art. 11 — Limitations and liability

Nothing in these terms limits rights or liability that cannot be excluded by law, including Consumer rights.

J.Rose is not liable for unlawful uses or uses contrary to instructions, for unavailability due to events beyond its reasonable control, or for content and services independently provided by third parties, except for what is directly attributable to J.Rose.

Art. 12 — Changes to the Terms of Use

J.Rose may update these terms for regulatory, technical, organisational or functional changes. The current version and the update date are published on the site.

Substantial changes affecting accounts or continuing services are communicated in a proportionate manner, when required.

Art. 13 — Governing law and jurisdiction

These terms are governed by Italian law, without prejudice to the more favourable mandatory rules applicable to a Consumer resident in another country.

For disputes with a Consumer, the court of the Consumer's place of residence or domicile has jurisdiction where provided by law. For relations with professional users, the Court of Lecce has exclusive jurisdiction, subject to mandatory rules; for Professional Customers making purchases, this clause is subject to specific approval at checkout pursuant to Articles 1341 and 1342 of the Italian Civil Code.

Terms of Sale

Art. 1 — Seller and support

The seller is AFFRESCHI & AFFRESCHI S.R.L., a single-member company with registered office at Via Giurdignano SNC, Zona PIP, Lotto 9/A, 73027 Minervino di Lecce (LE), registered with the Lecce Register of Companies under registration number and tax code 04779110750, REA LE-317690, VAT number 04779110750, fully paid-up share capital of euro 10,000.00, PEC affreschisrls@pec.it, email info@jrose.it, telephone 0836 891054 (hereinafter also “J.Rose” or the “Seller”).

Art. 2 — Structure of the contract and precedence

These Terms of Sale govern purchases made through www.jrose.it and must be read together with the Payments, Shipping and Returns & Refunds sections, which form an integral part of them.

The specific information on the product page, in the cart and in the final summary completes the contract. In the event of conflict, the more specific provision relating to the product or the transaction prevails, provided it was shown before the order and complies with the law.

Limited Editions, pre-sales, Membership, Collectors Club, Wallet, Message in a Bottle and other special services may be governed by dedicated rules. Such rules prevail for the project concerned; these terms apply on a residual basis to the extent compatible.

Art. 3 — Customers and age requirements

A “Consumer” is an individual who buys for purposes outside their business, commercial, craft or professional activity. A “Professional Customer” is anyone who buys in the course of such activity.

In Italy, the purchase of alcoholic beverages is reserved for persons aged at least 18. For foreign destinations, the minimum age of the country of delivery applies, never below 18. The buyer declares that they meet the requirement and that they will name a suitable recipient.

J.Rose may verify the year of birth by means of the tax code, request a document when age is not obvious, and instruct the carrier to check it on delivery. If verification fails, the order or delivery may be refused in accordance with the rules published in the Shipping section.

The retail catalogue may be used by the Professional Customer for consumption, hospitality or gifts, but not for resale. Resale is governed by the B2B channels, agents or the professional portal.

Art. 4 — Products and artisanal characteristics

The catalogue may include alcoholic beverages, glasses, accessories, gift packs, books, prints, editorial products, clothing, merchandising, digital gift cards and other products indicated on the site.

Before the order, the essential characteristics, the price, the net quantity and the alcohol content where applicable are shown, together with the other mandatory information available on the product page.

Images are for descriptive purposes. Minor variations in tone, grain, texture, thickness, finish or hand-made marks on labels, frescoes and artisanal elements are not defects when they do not compromise integrity, legibility, safety, functionality or quality.

Breakages, abnormal cracks, significant detachments, serious printing defects or missing components do not fall within normal artisanal variability.

Art. 5 — Prices, taxes and costs

Prices are expressed in euro and include applicable VAT. Shipping, surcharges and the total due are shown before the final command.

For foreign destinations, checkout normally calculates the total on a DDP basis, including product, transport, applicable taxes, excise duties and customs duties, as described in the Shipping section.

Payment methods, charging times, cash on delivery, bank transfer, gift cards, anti-fraud checks and invoicing are governed by the Payments page.

Art. 6 — Account, guest and recipient

The Customer may buy as a guest or through an account, when available. They must provide complete and correct details and keep their credentials safe.

A recipient other than the buyer may be indicated. The Customer warrants that they may communicate the data necessary for delivery, that they have informed the recipient where appropriate and, for alcoholic beverages, that the recipient is of the required age.

J.Rose may suspend an account for reasonable reasons of security, fraud, unlawful use or breach of the terms, stating the reason where possible.

Art. 7 — Ordering procedure and conclusion of the contract

The Customer selects the products, checks the cart, enters their details, chooses delivery and payment and reviews the summary. Before submitting, they may correct errors by returning to the previous steps.

The order is submitted by means of a button labelled “Order with obligation to pay” or an equally unambiguous expression.

Before submitting, the Customer accepts the Terms of Sale and the Payments, Shipping and Returns & Refunds sections, declares that they meet the age requirements and acknowledges the Privacy Notice. Marketing consent is separate, optional and not preselected.

For immediate payments, the contract is concluded when the payment is authorised and J.Rose sends the confirmation. For bank transfer, it is concluded upon receipt of the funds and confirmation. For cash on delivery, it is concluded upon order confirmation and the price is due on delivery.

J.Rose stores the order number, date, time, version of the contractual documents and the declarations made, and sends a confirmation on a durable medium.

The Customer may request cancellation with a full refund until the order has been handed to the carrier. After that point, the Returns & Refunds section applies.

Art. 8 — Availability, limits and substitutions

Availability is updated with reasonable diligence, but simultaneous orders may exceptionally cause misalignments.

No minimum amount or general limit on bottles is provided. Specific limits may be applied, visible before the order, for availability, destination, fraud prevention or protection of the retail channel.

In the event of unavailability after payment, the Customer may choose, where possible, between waiting for an accepted date, an expressly approved alternative, a refund of the missing product, or cancellation of the entire order where a partial delivery would be of no interest.

J.Rose does not automatically substitute the product with a different item.

Art. 9 — Cancellation by J.Rose

J.Rose may cancel and refund the order in the event of a manifest and objectively recognisable pricing error, well-founded suspicion of fraud, unauthorised payment, legal prohibition, unforeseeable supervening unavailability or objective impossibility of delivery.

Cancellation is communicated to the Customer and the sums collected for the part not performed are returned in the manner provided on the Payments page.

Art. 10 — Gift cards and special services

The J.Rose gift card is digital, usable exclusively on www.jrose.it and governed in detail in the Payments and Returns & Refunds pages.

The gift card cannot be used to purchase another gift card, Limited Editions, Message in a Bottle, Membership or other services expressly excluded.

The special conditions of dedicated projects must be accepted before the relevant purchase or activation.

Art. 11 — Professional Customers

The right of withdrawal, the statutory warranty of the Consumer Code, the consumer's forum and the other protections reserved for Consumers do not apply to the Professional Customer.

Professional sales are governed by the Civil Code, including the provisions on warranty for defects and the related time limits, where applicable.

Except in cases of wilful misconduct, gross negligence, personal injury, product liability or mandatory limits, J.Rose's total liability towards the Professional Customer is limited to the value of the order concerned. Indirect damages, loss of profit, opportunities or business interruption not directly and foreseeably caused by the breach are excluded.

Art. 12 — Liability and force majeure

J.Rose does not limit liability or rights that cannot be excluded by law. The Consumer's mandatory rights remain intact.

J.Rose is not liable for delays or non-performance due to events beyond its reasonable control, such as natural disasters, fires, general strikes, wars, orders of the authorities, customs blocks, exceptional unavailability of transport or widespread interruptions of networks and systems, provided it adopts reasonable measures and informs the Customer.

If performance becomes definitively impossible, the order is cancelled and the part not performed is refunded.

Art. 13 — Intellectual property

The purchase does not transfer rights in the works, trademarks, images, labels, packaging or other artistic content. Normal use of the product and uses permitted by law are allowed.

Art. 14 — Privacy

Personal data is processed in accordance with the Privacy Notice published on the site. Acknowledgement of the notice is distinct from any consent to marketing.

The data necessary for the order may be communicated to payment providers, IT suppliers, couriers, logistics operators, consultants and parties involved in legal obligations, according to the roles described in the notice.

Art. 15 — Complaints and ADR

Complaints and requests may be sent to info@jrose.it, stating the order number and any useful information.

The Consumer may apply to the competent ADR bodies. J.Rose assesses participation on a case-by-case basis and does not undertake in advance to use a specific body, except for legal obligations or subsequent adherence.

The European ODR platform has been discontinued and the related regulation was repealed with effect from 20 July 2025.

Art. 16 — Governing law and jurisdiction

The contract is governed by Italian law, without prejudice to the more favourable mandatory rules applicable to a Consumer resident in another country.

For the Consumer, the court of the place of residence or domicile has jurisdiction where provided by law. For the Professional Customer, the Court of Lecce has exclusive jurisdiction.

Art. 17 — Version, language and partial invalidity

The version shown and accepted at the time of the order applies. Future changes do not affect contracts already concluded, except for legal obligations or more favourable changes.

The contractual language is Italian. Translations are for information purposes and, in the event of discrepancy, the Italian text prevails to the extent permitted by law.

The invalidity of any clause does not affect the effectiveness of the remaining provisions.

Specific approval by the Professional Customer

The Professional Customer, pursuant to Articles 1341 and 1342 of the Italian Civil Code, declares that they specifically approve: Terms of Use, Art. 13; Terms of Sale, Arts. 3, 7, 8, 9, 11, 12, 16 and 17; Payments, Arts. 4, 5 and 8; Shipping, Arts. 6, 9 and 11.

Payment Methods

Art. 1 — Prices and currency

Prices are expressed in euro and include applicable VAT. Before the order, the price of the products, shipping, any surcharges, taxes and the total due are shown.

For international sales the total is normally calculated DDP in accordance with the Shipping page. The card issuer or the Customer's bank may apply its own exchange rate or fees that are not collected by J.Rose.

Any future promotions, discount codes or gifts are governed by the specific conditions published for the initiative. Where required, the reduction will refer to the applicable previous price.

Art. 2 — Available methods

The methods actually available are shown at checkout and may include cards via Stripe or Nexi, PayPal, Apple Pay, Google Pay, Revolut, bank transfer and cash on delivery for eligible Italian orders.

J.Rose does not apply surcharges linked to the payment method, except for the euro 5.00 fee for cash on delivery.

The Customer must use a valid payment method that they are authorised to use.

Art. 3 — Immediate payments

For cards, PayPal, Apple Pay, Google Pay, Revolut and other immediate payments, the amount is authorised in accordance with the provider's rules and the contract is concluded when the payment succeeds and J.Rose sends the order confirmation.

If authorisation fails, the order is not concluded. Any pre-authorisations or temporary movements depend on the intermediary and are released according to its technical timescales.

Art. 4 — Bank transfer

With bank transfer, the order remains pending and products are shipped only after the funds are actually received.

The Customer must state the order number in the payment reference and pay the exact amount to the bank details given in the confirmation.

If the funds are not received within 7 working days, J.Rose may cancel the order and make the products available again.

Art. 5 — Cash on delivery

Cash on delivery is available only for eligible Italian orders and involves a surcharge of euro 5.00, added to the ordinary shipping cost of euro 5.50.

It is not available for foreign shipments, gift cards, Limited Editions, reservations, pre-sales, digital content or special services.

The Customer must arrange payment in the manner accepted by the carrier. Unjustified refusal or failure to be available to pay may result in a charge for only the actual, documented costs within the limits of the law.

Art. 6 — Digital gift card

The J.Rose gift card is a prepaid digital code that can be used exclusively on www.jrose.it. It is generated after payment confirmation and sent immediately to the email of the recipient indicated by the buyer.

The buyer is responsible for the accuracy of the address. Support may correct it and resend the gift card only if the code has not been used.

The gift card is valid for 12 months from the date of purchase. The expiry is shown on the product page, at checkout and in the code delivery email.

It can be used more than once; the remaining balance stays available until expiry, earns no interest and cannot be converted into cash.

It can pay for ordinary products and shipping costs. It cannot be used to purchase another gift card, Limited Editions, Message in a Bottle, Membership or other excluded special services.

Only one gift card is allowed per order. If the balance is insufficient, the difference can be paid with another available method.

The gift card is transferable and must be kept like cash. J.Rose may block and reissue it in case of loss, theft or disclosure only if it is still unused and the buyer proves the purchase.

If it is redeemed to buy alcohol, age verification takes place at the time of the order. Withdrawal from a gift card is governed by the Returns & Refunds page.

Art. 7 — Payment errors and double charges

A Customer who notices a double charge, a successful payment without confirmation or a wrong amount must contact info@jrose.it stating the order number, date and method, without sending passwords, PINs or the full card number.

J.Rose checks the transaction with the provider and, if the amount was collected without a valid order or in excess, arranges the reversal or the refund due.

Art. 8 — Anti-fraud checks

J.Rose and the payment providers may suspend the transaction, request proportionate checks, or cancel and refund the order where there are indicators of fraud, false data, an unauthorised method, card testing, automated attempts or repeated failures to accept previous deliveries.

Checks must be proportionate and never involve requests for passwords, PINs or the full card number by email, telephone or WhatsApp.

The suspension is reviewed as soon as the necessary elements are available. In the event of cancellation, the sums collected are refunded.

Art. 9 — Invoicing

J.Rose issues an invoice for every order. The Customer must provide complete and correct tax details before confirmation, including tax code, VAT number, PEC or SDI code when required.

Subsequent corrections are possible only within the limits and time frames allowed by tax law.

Art. 10 — Refund methods

Refunds are made using the same payment method used, unless otherwise agreed and at no cost to the Consumer.

For cash on delivery, or where a refund to the original method is technically impossible, the Customer must provide an IBAN held by or attributable to the entitled party.

The conditions, amounts and timing of refunds for withdrawal, damage or defects are governed by the Returns & Refunds page.

Art. 11 — Security and payment data

Full card details are processed by the payment providers in accordance with their respective security standards and notices. J.Rose receives only the information necessary to manage the outcome, the order, disputes and accounting obligations.

The Customer must not send full card details, passwords or authentication codes to the support contacts.

Art. 12 — Support

For payments, gift cards, invoices and refunds: info@jrose.it. Please state the order number and do not send confidential credentials.

Shipping Times

Art. 1 — Address and recipient

The Customer must provide a complete address, a reachable contact and all the information necessary for delivery.

Delivery may be made to the buyer, to the named recipient or to another adult present at the address, including a family member, the concierge or the reception.

Collection from the registered office, warehouse, showroom or point of sale is not available.

Art. 2 — Shipping costs in Italy

Ordinary shipping in Italy costs euro 5.50 including VAT. There is no ordinary free-shipping threshold.

If cash on delivery is selected, a surcharge of euro 5.00 is added, for a total delivery cost of euro 10.50.

The total is always shown before the order is submitted.

Art. 3 — Destinations served

Products that do not contain alcohol may be shipped only to the destinations made available at checkout, in compliance with the applicable regulatory, customs and logistics restrictions.

As of the date of this version, checkout may enable shipments containing alcohol to the following destinations:

  • Andorra; Antigua and Barbuda; Argentina; Australia; Austria; Bahamas; Belgium; South Korea;
  • Denmark; United Arab Emirates; Finland; France; Germany; Japan; Hong Kong; India; Canary Islands;
  • Italy; Lithuania; Luxembourg; Norway; New Zealand; Netherlands; United Kingdom; Czech Republic;
  • Singapore; Slovakia; Slovenia; Spain; South Africa; Sweden; Switzerland.

Sales to Russia are suspended. The actual availability of a product/destination combination must be shown at checkout and may change for regulatory, tax, customs or logistics reasons.

Art. 4 — International shipments and DDP terms

Outside Italy, the Way To Go integration normally manages the international logistics process and UPS provides transport and tracking. The seller remains AFFRESCHI & AFFRESCHI S.R.L.

Unless clearly indicated otherwise before the order, the foreign price is calculated DDP and includes product, transport, VAT or equivalent taxes, excise duties and applicable customs duties.

The recipient does not have to pay any further ordinary amounts on delivery. Only costs caused by inaccurate data, lack of cooperation or requests unrelated to the order remain payable by them, if actual, documented and permitted by law.

Art. 5 — Order preparation

Ordinary orders are normally prepared the same day or in the early hours of the following morning and handed to the carrier on the first working day after payment.

For bank transfer, preparation starts from receipt of the funds. Special products may have different timescales indicated on the product page, in the dedicated rules or in the confirmation.

Art. 6 — Indicative delivery times

In Italy, transit normally takes 2–3 working days from handover to the carrier.

For foreign destinations, Way To Go normally collects within about 2 working days; the UPS times indicated for the destination are then added.

Times are estimates and may vary for islands, remote areas, customs, public holidays, order peaks or events not attributable to J.Rose.

Unless a different date is agreed, delivery to the Consumer takes place within the maximum time limit provided by law and, as a rule, no later than 30 days from conclusion of the contract.

Art. 7 — Delivery of alcohol and age verification

In Italy, the buyer and the recipient of alcoholic beverages must be at least 18. Abroad, the minimum age of the country of delivery applies, never below 18.

J.Rose may request a check before shipping and the carrier may ask for a document when age is not obvious.

Alcohol is not delivered to minors, left unattended or sent to lockers that do not allow adequate age verification.

If age cannot be verified, delivery may be refused. The financial consequences of false declarations or lack of cooperation are governed by Article 9.

Art. 8 — Tracking and communications

Where available, the Customer receives the tracking link or code by email.

Carrier updates are indicative. The Customer must promptly report anomalies, blocks or a delivery shown as made but not received.

Art. 9 — Failed delivery attributable to the Customer

If delivery fails because of a wrong address, repeated absence, unjustified refusal, non-payment of cash on delivery, failed age verification or lack of cooperation attributable to the Customer, a new shipment may be made after payment of the related costs.

If a new shipment is not requested, J.Rose refunds the price of the products returned intact, deducting only the actual and documented costs of shipping, storage and return within the limits permitted by law.

Simply refusing the parcel does not constitute a valid declaration of withdrawal.

Art. 10 — Transfer of risk

As regards the Consumer, the risk of loss or damage passes when the Consumer or a third party designated by them, other than the carrier, takes physical possession of the products.

Art. 11 — Delays and causes beyond control

J.Rose is not liable for delays due to natural disasters, general strikes, wars, orders of the authorities, customs blocks, exceptional unavailability of transport, widespread network interruptions or similar events beyond its reasonable control.

J.Rose informs the Customer where possible and adopts reasonable measures to limit the effects. If delivery becomes definitively impossible, the order is cancelled and refunded.

Art. 12 — Checking the parcel on delivery

On delivery the Customer is invited to check the number of packages and the packaging and, in the presence of visible damage, to accept with a specific reservation where possible.

Reports, replacements, collections and refunds for wrong, broken or damaged products are governed by the Returns & Refunds page (Art. 8).

Art. 13 — Shipping support

For tracking, delays, failed delivery or damage: info@jrose.it. Please state the order number, the recipient and a description of the problem.

Returns and Refunds

Art. 1 — Consumer's right of withdrawal

The Consumer may withdraw from the purchase of goods within 14 days without giving any reason.

The period runs from the day on which the Consumer, or a third party designated by them other than the carrier, takes physical possession of the goods. For several goods delivered separately, it runs from the last delivery.

The right of withdrawal does not belong to the Professional Customer and does not apply in the cases expressly excluded by law, including the one indicated in Art. 6.

Art. 2 — How to communicate withdrawal

Within the 14-day period the Consumer must send an unequivocal statement to info@jrose.it or by PEC to affreschisrls@pec.it.

The Consumer may also exercise withdrawal through the “Withdraw from the contract here” function, or similar wording, made available continuously throughout the withdrawal period, clearly visible on the interface and easily accessible (Art. 54-bis of the Consumer Code).

Once the online withdrawal statement has been completed, the Consumer submits it using the “Confirm withdrawal” button. J.Rose transmits without undue delay, on a durable medium, an acknowledgement of receipt containing the content of the statement and the date and time of transmission. Withdrawal is deemed exercised in time if the online statement is sent before the withdrawal period expires.

The attached form may be used, but is not mandatory. The communication must make it possible to identify the Customer, the order and the goods concerned.

Simply refusing the parcel or failing to accept delivery does not constitute a valid declaration of withdrawal.

Art. 3 — Deadline and address for return

After communicating withdrawal, the Consumer must send the goods back within 14 days to:

The shipment must be adequately protected and allow proof of the date of dispatch. Direct returns to a showroom or point of sale are not available without prior written agreement.

Art. 4 — Return costs

In the case of simple change of mind, the direct cost of returning the goods remains the Consumer's responsibility.

For a damaged, wrong or non-conforming product, J.Rose bears the necessary costs and, where appropriate, arranges collection through its own logistics service.

The Customer must not ship independently at J.Rose's expense without instructions, except in urgent cases or by agreement.

Art. 5 — Condition of the returned product

The Consumer may handle the goods only as far as necessary to establish their nature, characteristics and functioning and is liable for any diminished value caused by further handling.

Opening only the shipping packaging does not exclude withdrawal. The product must be returned with the packaging, accessories, documents and materials received.

Damage to the artistic packaging, missing accessories or excessive handling may result in a proportionate reduction of the refund.

Art. 6 — Sealed bottles: exclusion of withdrawal

Pursuant to Art. 59(1)(e) of the Consumer Code, the right of withdrawal is excluded for sealed goods that are unsuitable for return for reasons of hygiene or health protection, where they have been opened after delivery.

A bottle whose seal has been opened, removed or compromised after delivery therefore cannot be returned for change of mind. Withdrawal remains exercisable for goods in the same order with the seal intact, under the conditions of Art. 5.

This exclusion is indicated to the Consumer before the order. The other exclusions provided by Art. 59 of the Consumer Code remain in force, where concretely applicable, together with the dedicated conditions of special services and projects.

Art. 7 — Refund after withdrawal

J.Rose refunds the price of the goods returned and, in the case of withdrawal from the entire order, the cost of the initial standard delivery. It does not refund surcharges arising from a different and more expensive delivery method chosen by the Consumer.

The refund is made within 14 days of the communication of withdrawal using the same payment method, unless otherwise agreed and at no cost to the Consumer.

J.Rose may withhold the refund until it has received the goods or until the Consumer proves that they have been sent, whichever is earlier.

For cash on delivery or where the original method is technically impossible, the Consumer must provide an IBAN held by or attributable to the entitled party.

Art. 8 — Wrong, broken or damaged product

On delivery the Customer is invited to check the number of packages and the packaging. In the presence of visible damage they must, where possible, accept with a specific reservation.

The problem must be reported promptly to info@jrose.it, keeping the product and packaging and attaching photographs or a short video useful for verification.

The lack of a reservation or of photos or video does not automatically forfeit mandatory rights, especially for damage not visible at the time of delivery.

J.Rose arranges free of charge the replacement of the wrong, broken or non-conforming product and organises any collection. If replacement is not possible or the legal conditions are met, further remedies apply, including price reduction or refund.

Art. 9 — Statutory warranty of conformity

The statutory warranty of Art. 128 et seq. of the Consumer Code applies to Consumers. J.Rose is liable for defects existing at delivery and manifesting within 2 years.

The Consumer is entitled first of all to free restoration by repair or replacement, at their choice, unless impossible or disproportionately costly. In the cases provided, they may obtain a price reduction or termination of the contract.

Remedies are carried out free of charge, within a reasonable time and without significant inconvenience. No commercial warranty limits statutory rights.

The normal artisanal variability described on the product page and in the Terms of Sale is not a defect if it does not compromise integrity, legibility, safety, functionality or quality.

Art. 10 — Withdrawal from the gift card

The Consumer may withdraw from the purchase of the gift card within 14 days only if the code has never been used.

After first use, even partial, the gift card cannot be converted into cash, without prejudice to mandatory rights.

The refund of an unused gift card is made to the original payment method. The code is deactivated at the same time.

Art. 11 — Professional Customers

The Professional Customer is not entitled to the 14-day withdrawal and to the warranty of the Consumer Code.

The Civil Code applies, including the warranty for defects and the related time limits, where applicable. The Professional Customer must inspect the products diligently and promptly communicate any complaints.

Art. 12 — Return for failed delivery

The return of the parcel for reasons attributable to the Customer, the costs deductible from the refund and the conditions of the new shipment are governed by the Shipping page (Art. 9).

J.Rose communicates the return instructions and updates the Customer on the outcome of the request.
